These Terms of Service ("Terms") govern your use of Luma Webs' website and web design services. By engaging our services or using this website, you agree to these Terms. Please read them carefully.

Services

Luma Webs provides web design, development, hosting, and maintenance services for local businesses. Our service packages include:

Core Website: Up to 5 pages, mobile-optimized, basic SEO, contact form, Google Maps embed. Delivery: 3-5 days.
Pro Website: Up to 10 pages, includes everything in Core plus online menus, booking widgets, or other complex integrations. Delivery: 7-14 days.
Custom Build: Fully custom design with e-commerce and other specialized features. Delivery timeline determined per project.

Delivery timelines begin once all project details are finalized and required content is provided by the client.

Free Mockup

We offer a free homepage mockup before any payment is required. This allows you to see our design approach before committing. The mockup remains our intellectual property until you proceed with a paid engagement.

Payment Terms

Payments are processed through Stripe. The following terms apply:

An upfront fee is due before project work begins (after mockup approval)
Monthly maintenance fees are billed automatically and include hosting, security updates, and minor content changes
Recurring charges continue until you cancel your subscription
All prices are in Canadian dollars unless otherwise specified

Refunds

Due to the custom nature of our work:

No refunds are provided once work has been completed and delivered
If you decide not to proceed after the free mockup stage, no payment is required
Once you approve the mockup and pay the upfront fee, the project is considered in progress and fees are non-refundable
Monthly maintenance fees are non-refundable for the current billing period

Monthly Maintenance

All plans include monthly support and maintenance, which covers:

Website hosting on reliable servers
Security reviews and updates
Minor content updates as needed
Technical support for your website

Cancellation Policy

You may cancel your monthly maintenance subscription at any time. Upon cancellation:

We will provide you with all website files so you can self-host
We will no longer be responsible for hosting or maintenance
Any issues arising after cancellation are your responsibility

Termination

We reserve the right to terminate or suspend services at our discretion if:

You engage in abusive, threatening, or harassing behaviour towards us
You use the website or our services for illegal purposes
You breach any of these Terms

In the event of termination due to such conduct, no refunds will be provided for any fees already paid.

Intellectual Property

Upon full payment of all fees:

You own the final website design and content created specifically for your project
We retain the right to display the work in our portfolio unless you request otherwise
Third-party assets (stock photos, fonts, plugins) are subject to their respective licenses

Until full payment is received, all work remains our intellectual property.

Client Responsibilities

To ensure timely delivery, you agree to:

Provide all required content (text, images, logos) in a timely manner
Respond to communications and feedback requests promptly
Provide accurate business information
Ensure you have rights to any content you provide

Domain Names

You may use your own existing domain, or we can purchase one on your behalf. If we purchase a domain for you:

You cover the domain registration costs
The domain will be registered in your name
We handle all technical DNS setup

Limitation of Liability

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, or consequential damages arising from our services
Our total liability is limited to the amount you paid for services in the preceding 12 months
We are not responsible for losses resulting from third-party services, hosting outages beyond our control, or your misuse of the website

Website Use Disclaimer

This website and its content are provided "as is." While we strive for accuracy, we make no warranties about the completeness or reliability of any information on this site.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the new Terms.
